    Most likely it is sitting in a basket at the NVC with a low priority, because it is quota-based and the Priority Date is is not near reachable.

    What I am finding with a few that I have submitted like this is that USCIS approves, then forwards on to the NVC, and a little later (a few weeks, perhaps), you receive a notice that the NVC has the case but that a visa slot is no yet available, so don't quite our job, buy airline tickets, etc., yet.

So I think I do not have a State Department Case number yet, So does that mean my petition could still be in the California Service Center because that what where I received the I-797 from Laguna Niguel, CA right? Even though the I-797 mentions they sent it to NVC OR it is at the NVC but just haven't processed it because I only have the receipt number from the I-797 form nothing about that its processing...

      Interesting things that one learns about immigration... I think your right, because when i called them at the NVC, they can open the file and me and my wife's information is in the computer, but they just haven't proceeded with consular processing due to current "permanent resident" status showing on the file in the computer and like you said it's just sitting there waiting... So then what do you advise I should do? Just keep calling, emailing the NVC to remind them to upgrade my wife's petition? thank you

        You have two steps to take:

        1. Obtain NVC case number;
        2. With the case number, proceed with regular queries regarding changing status of petition because of your naturalization.
