  • Residing in Canada - Affidavit of Support?

    Hi there,

    I'm an American citizen, I've been married to my Canadian Husband for 6 years now, and have lived with him in Canada as a permanent resident for almost 5 years. We've talked a lot about wanting to move back to Ohio, and have started looking into the immigration process. I want to make sure we even CAN move back before we even start attempting it.

    I've read a lot about the affidavit of support. We are planning on staying in Canada until his permanent residency goes through. My Husband works, I do not, so I have no income myself. I'm not sure what to do about the affidavit of support because of this - obviously I can't prove I can provide for him. My Sister (who lives in Florida and works in the Navy) told me she is willing to co-sponsor with me. Is this enough, or what should I do?

    Thanks so much in advance. I haven't had much luck finding info on this.

    You will have to be primary sponsor, even without employment or income. Your sister can be a joint sponsor, with her own I-864 package.

    But you must plan on moving back to U.S. to establish a domicile, or to return to the U.S. when your guy gets his visa.

      If we move back to the US after he gets his visa, will he be able to work before I have to do the affidavit? (I'm not able to work at this time)

        Your sponsorship documents (Affidavit of Support) must be submitted to the Natioal Visa Center before your husband gets his visa.

          I am in the same boat, my wife is on visitor record in Canada for last one year but she is maintaining her domicile , means she has bank account, billing and car payments which she manages from here and of course we go to states once a month to meet my parents and her's. You just have to get necessary documents I130 which needs to be approved and then the supporting documents I864 and joint sponsor.

          I have sent the supporting document which includes joint sponsor I864 to NVC to review and probably the next step is to get interview from local office in Montreal .

            Hi hello! I see this post is from a few years ago but I have somewhat of a similar situation and would hope to get advice. Currently living and working in Singapore with my Singaporean husband. I have not started the I-130 petition yet as there is no clear processing time and fear when i finish my contract (december) here and prepare to head to the U.S. first the Affidavit of support will rear its head and I wont be prepared. Is it better to settle back into the U.S. i.e. having employment and residing back home for a bit and then start the petition or would I set myself back in the waiting time? I may start the process in September with the hopes it will take a few months and by then I'd be back and working. I don't have many reliable people for joint sponsorship so it's really up to me. ???? i'm so stressed!
