    Steph,

After you have sent the petition to USCIS, Stateside, and it is approved, you then pay the National Visa Center $120 and $325 and send the National Visa Center sponsorship and civil documents.

The National Visa Center then sends you an Embassy appointment notice that is a trigger for your wife to get an immigrant medical exam, get her paperwork proving relationship together, and goes to her interview. After a successful interview, the visa is then delivered to her or picked up by her in 3-10 days (most consulates, not sure about Japan).

You will then have to pay a $165 Green Card fee online to USCIS for your wife's Green Card to be mailed to her in states a month or two after she arrives here.

I'm sorry for not understanding correctly. I'm just trying to get a grasp on the timing and planning of our move back to the States. Basically, after the I-130 is approved, my wife will be scheduled for an interview at the embassy here in Tokyo and if all goes well, she will receive a spousal visa on that day which is good for about 6 months from the date? After this, there wouldn't be anything else we need to submit in order for my wife to travel to the US? All other documents could be submitted from the US?

    Thanks again.

      Hello Ray,

I understand. Would there be a need for me to stay in Japan (to be present at the interview, file further documentation, etc)? If I return to the States, would I need to come back to Japan during the remaining process?

How would my wife be notified that the I-130 was accepted and that we would have to then pay the $120 and $325 to the National Visa Center? What sort of sponsorship and civil documents would we need to submit along with those payments?

      Thank you very much.

Your wife will receive a packet from the National Visa Center after the I-130 petition is approved, giving her (and you) instructions for paying the first fee, $120.

You don't need to be in Japan for her interview.

I understand. If I am not in Japan when the packet arrives, are there any papers in it need to be filled out jointly (i.e. signatures required by me or forms my wife would have to fill out)? When does the $325 fee come into play? (likewise, when submitting the $325 fee, would there be any forms to sign and/or submit)?

          Thank you very much.

            Steph,

After the $120 sponsorship processing fee is paid to the NVC, you will have to sign the I-864 and send it, a tax return copy, proof of income and employment to the NVC.

Nothing else needs to be signed by you.

              Hello Ray,

I see...so in the packet, there will be some kind of form to send back with the payment or a letter saying how to make the $120 payment? Can we concurrently submit the I-864 form when making the $120 payment? Is there a $70 fee for the I-864? When would the $325 fee have to be paid?

              Thank you.

                Steph,

You must be looking at some very old NVC information. The $70 fee is now $120, which must be paid online to the NVC from a checking or savings account (other payment option is available, but online is best). After remitting the $120 online, you can immediately download an AOS cover page and submit the I-864 and supporting sponsorship documents.

The $325A fee bill shows up a couple of weeks later, after completing the online DS-261 form (Agent report).

                  Hello Ray,

I see. So, basically, after submitting the I-130 and it gets approved, we will receive a "packet" at the address we noted on the I-130 form and on that day we can remit the $120, download an AOS cover page and send in the I-864 with supporting documents?

Just a question about what address documents (i.e. the packet) will be sent to. Will that be sent to the address that I noted in Section B (Information about you) on the I-130? Does the address in number 18 (Address in the United States where your relative intends to live) mean much?

                  Thank you again.

                  Steph

slight information to add. NVC now requires that you send both AOS and civil documents together.

                      Itstaran,

Actually, there is no reason to send them together. Each group (AOS and civil documents) requires a separate cover page, and can be submitted separately. I prefer to send the two packets in the same envelope, but since the two fees are paid weeks apart, it is sometimes more convenient to send each packet alone, just to get it off your desk.

                        I-765

Am filling for my husband, we are sending the I-130 and the I-485 concurrently. My question is what will be the answer for question number 16 on the I-765 form. Is kinda confusing

The correct response to #16 on the I-765 is (c)(9)

It doesn't matter whether upper or lowercase.

Form I 485 part two, which one is the right box to tick application base on marriage, and my spouse is currently in the US?
