Stepfather petition to stepson

Just got married last August 09, 2014 to a U.S. citizen , I over stayed here for 4 years now my adjustment status is on process.Did already the biometrics and waiting for the next step or notice to do.Regarding this , should my husband can petition of my 16th year old son whose in the Philippines while waiting for my case to be adjusted or he can file now.Thanks

Your husband can petition your son, as the stepchild relationship, if the child was under age 18 when you married, is a petitionable basis.

Yes my son just turned 16,so my husband need only I130 form to start the petition right?Thanks.

Right. I-130, $420, proof of his citizenship, marriage to you and child's birth cert.

How about the income tax he had, salary pertaining to his job do I need to include also .Thanks

No, when the petition is submitted, the sponsorship proof does not accompany the petition. After the petition is approved, about 6 months later, and goes to the NVC, hubby will then have to provide sponsorship proof.
