Concurrent filing of I-130 and I-485 for my mom living in RO.Need answer ASAP plz

  • Concurrent filing of I-130 and I-485 for my mom living in RO.Need answer ASAP plz

    I am a little torn over this situation I'm in and would love some help from someone familiar with this.
    I am a U.S. citizen and my mother is currently living in RO. She has visited me before in TX, and only stayed for a couple of months. I have been reading about the neccessary forms to bring her over and Ive found out about concurrent filing and how for parents of us citizens, a visa number is readily available. I have already filled in I-130 and was filling in I-485 for her as well, but on the last page it seems her signature is required. I put down my name and signature as the person who translated and filled in the form, but not sure if the form has to be signed by her personally. If so, I will have to mail her the form and then have it mailed back to me. Also on the form is specifies that the form is to be filled in while the beneficiary is in the US, but she isn't sothat brings up the question if I should even fill it in for her. I certainly don't want to fly her over here on her visitor visa and then apply for I-485. I read that that's actually not a goood idea...is it? I wrote the checks and I am working on my 864 and 864a forms, not concerned with those tho. I just wanted to mail everything out along with g1145 and be done with papers for a while. Now it seems I have to go through baby steps. Does she have to personally sign I-485 or can I fill it in for her? What's the point of concurrent filing if I can't do the paperwork for her. Would love to know more, thanks

    You can't do "concurrent filing" if your mom is being processed for an immigrant visa outside the U.S.

    By "RO," do you mean Romania?

      Yes, RO is short for Romania. So I should do I-130 first to establish relationship then? Does the fact that she has a visitor visa help me with anything? And then I assume she has tp be the one filing I-485? Now I'm even more confused.

        There is no reason for you to be confused about this. Your confusion might be the result of seeing so many threads on this forum about "concurrent filing," which is not the most common strategy for immigrants obtaining Green Cards.

        It is really quite simple:

        1. If you mom is in the U.S., you can concurrently file the I-130 and I-485 at the same time.
        2. If your mom is not in the U.S., you cannot file the I-130 and I-485 at the same time. Just file the I-130 and she will be processed at the U.S. Embassy in Romania for her immigrant visa.

          Thank you, Ray. Now about all these people who bring a parent in the US on a tourist visa then turn around and file 130 and 485. Isn't it a big no-no? Because if that's an option I'll be more than happy to do it.
          Also, if I only file I-130 and that gets approved, then she has to send in I-485 locally in Romania?

            You can't submit the I-485 unless you are doing concurrent filing while she is in the U.S.

            The only way you can do concurrent filing in the U.S. is if she is in the U.S.

            If you file the I-130 and she is processed for an immigrant visa in Romania, THERE IS NO I-485 INVOLVED. She will get an immigrant visa in Romania, travel to the U.S., then get a Green Card after you pay the Green Card fee.
