Can My bro Marry after conversion of his petition from F2B to F1??

Hello ,

my dad was an Indian citizen and became a Premanent resident of USA in 2009 and he Filed an F2B petition for my bro ( unmarried child of >21 yrs old )in Jan 2010.

Now , my dad became an US citizen in Oct 2014 , and my bro (28 yrs old ) is still unmarried. So , the Petition will automatically transfer to F1 .

i want to inquire whether , if he gets married after the conversion of Petition to F1 , then do we need to change it to F3 after his marriage?

Also , if it is to remain in the F1 category , then once his F1 petition opens up , then can his spouse and children come to US along with him? i would appreciate any help in this matter.

Yes, your brother can marry after your father becomes US citizen and transfer petition from F2B to F3.
(my brother has gone through it in 2002)
After your father becomes US citizen, Send a copy of Certificate of Citizenship and a letter requesting NVC to change Petition from F2B to F1.
Then after the marriage, Send the marriage certificate and a letter requesting NVC to change petition from F1 to F3.
Make sure you keep all the record(any receipts related to wedding) showing that marriage took place after your father became USC.
In my brother's case, US embassy in Delhi called our neighbours to confirm the date of marriage.

i dont know whether its true or not but i heard from my relative that once a file converts to F1 , and if my bro marries after that ; then he and his family can come on F1 only? on basis of V- visa?
i dont have much idea about it and am still researching on that matter?

No, It is not Ture. Once F1 (Unmarried Sons of US Citizen) beneficiary marries, He prefernce category will be converted to F3 when you present your marriage certificate to NVC or Consular officer.

I would like to only confirm one thing here....When the Preference Category is changed to F3 after marriage (note: marriage is done after the file got converted from F2B to F1), the File will open when the F2B category becomes current or F3 becomes current?
