Need help because I am confused.
I am currently on H1B (engineer) in my 4th year of that status.
My brother is a US citizen and filled I-130 in 2010 for me, which will be approved this year.
I am not sure, but I think H1B is only for 6 years and then my employer has to go through the process (posting a job, proving that there is not qualified US worker, etc.) to sponsor me.
I am not sure that my employer will do so.
So, here are the questions:
- After my I-130 is approved, can I apply for EAD, I-765?
- NVC will contact me within 1 year after USCIS I-130 approval, right? Is that when I get in que for priority date? Which is like 10 years, right? So, that means unless I get a visa number, I cannot apply for I-485, right?
Basically, I am worried that my employer will not sponsor me. Also, I'm worried about travelling outside the US and not being able to get back in.
