  • step parent petition to step child outside the US

    Hi to everyone,
My husband (US citizen) would like to bring my son here in the US, should he only file for i-130, G-325a and affidavit of support? or does he need to file i-485.
My son is 13 years old. Im wondering if it's easier to bring him here with i-130 or together with i-485. Please clarify.

    THanks

The I-485 is only used when the Green Card applicant is already in the U.S. Your husband needs only file the I-130 for the child. The G-325A is not needed for a child petition. The sponsorship documents submttal comes after the petition is approved and is at the National Visa Center.
