    I am a US citizen. If my father comes to the US on a tourist visa, can I apply for his Green Card (I-130 form)? If yes, should I wait for a certain number of days/months before filing Form I-130, Petition for Alien Relatives? Thanks for your suggestions.

        Follow Up Question on I-130 application

        My parent has visitor visa until first week June, 2015. I can sponsor him using I-130, Petition for Alien Relative, in mid March, 2015, along with I-864 Affidavit of Support, and I-485 Adjustment of Status. My question is - if I do not hear back a decision on his I-130 application before first week June (which is when his tourist visa expires), should he return to India or can he continue to stay in US until we hear about the decision on I-130? Thanks for your help.

          If you have proof of acceptance of your petitions' submittal, expiration of his allowable visa stay can be ignored.

                Your I-693, in sealed envelope, is submitted with your I-485. It has nothing to do with your I-130, the latter of which can be submitted before or at the same time as the I-485. If the I-130 is submitted before you submit the I-485, include a copy of the I-797 Receipt Notice of Action for the I-130 in your I-485 packae.

                  Thanks for the reply! It has been very helpful.
                  So, if one is filing the I-485 along with I-130 then it is important to submit, in a sealed envelope, the I-693 along with it.

                    The inclusion of the I-693 has nothing to do with the I-130.

                    The I-130 can be submitted before the I-485 or with the I-485.

                    The I-693 envelope MUST be submitted with the I-485.
