Filing I-130 and G325A for wife..Need some expert help please..

  • Filing I-130 and G325A for wife..Need some expert help please..

    I got married in September and ever since I am trying to fill the forms but people have been directing me in various wrong directions. Before I ask anything, let me fill you up on the information.

    I am a United States citizen who got married to an Indian Citizen on September 28th. I need to bring my spouse to USA. so I guess I need to file for I-130 for her, and in order to file for I-130 I guess I need to file G-325A.

    Question 1. I need to file 2 G325A, one for me and one for my spouse. When I am filing for myself.. I will fill the entire form with my information except the area where they are asking for "Current Husband or Wife". In this area I will place my Spouse's Information. BUT, when I am filling the form out for my spouse i am having a lot of confusion. there are parts in the form where it says "Applicant's residence for last 5 years", "Applicant's employment last 5 years", "Signature of Applicant", "Applicant: print your name and Alien Registration Number in the box outlined by heavy border below." in these places, when I am filling it for myself these are self explanatory, but when I am filling it for my spouse they are very confusing. when I am filling it, I am the applicant right? so if she is filling it she's the applicant? she will sign it? at the bottom she will type her applicant name etc?

    Question 2. Upon filling out G325A I will file I-130 as well? so g325 and i130 will go together at the same time correct?

    Question 3. any other form I should be sending with g325 and i130?

    Question 4. When will she be able to file for her non immigrant visa from India? She lives in India btw.

    I really need to file this ASAP.. please advice.

    Your submittal package must contain the I-130 and G-325A forms (the latter from each of you). Everything on each G-325A form is about the person filling it out, excepting the spousal line.

    You must include birth and marriage certs, $420 fee, proof of time spent together, passport-style photos of each, photos of you both together.

    After you submit this petition package, your wife cannot expect approval for a visitor visa, because your submittal of her spousal petition is "expressed intent to immigrant," a reason for denial of a visitor visa.

      I am talking about K3 Non Immigrant Visa for spouse. how soon after submitting the I-130 and G325A can she apply for K3?

        K3 visas are not actively supported by USCIS anymore. You can submit the K3 I-129F, but it will not be forwarded to the NVC or Embassy, if the I-130 is processed normally.

        You can submit an I-129F for a K3 soon as you have the I-130 receipt Notice, but you are probably wasting your paper.

          Suggestion

          I would suggest that you go over the uscis site and the info to file the I-130 plus read the whole requirements in the instructions to file this form.
