  • impact of spouse's death on Brother's immigration case

    Hi
My sister-in law has filed for her brother's immigration in 2006
now she is waiting for the priority date
    to become current
last month her Husband Died here
does her becoming 'widow' impact/help her brothers immigration case?

Sorry for the loss. Your sister in law's husband's death, will not have any impact on the application, even if he was the applicant. There r rules and instructions uscis, has in place if the petitioner is deceased. However, in her case it does not apply. I believe, however, if she had on the original application, that she was married, that she should inform, uscis, when the case becomes current and at that time have a copy of death certificate to submit to uscis. This is important, for household member count. Under this circumstance it would b one less.

If your sister-in-law is petitioner her brother, your sister-in-law's husband's death has absolutely nothing to do with her brother's petition.
