  • Petition for my Brother

    Hi,
I filed a I-130 for 3 of my brothers 14 years ago. 2 of the brothers got their visas, but one of them still waiting for final outcome from the U.S Embassy in the Dominican Republic. His case was put on investigation because 40 years ago my brother had legal issues with drugs. he served his time and after that got married and raised a family. never ever had issues with the local law. He provided proved to the U.S embassy that this was a very long time ago and he has been clean for 40 years. I don't know what to do to get status of this application. U.S embassy does not response, they do not provide update over phone, etc.

what should I do? write a letter to U.S embassy looking for answer?

I would highly appreciate if any one had the same experience to share with me.

    many thanks

Your brother should have been given the open of submitting a "Waiver of Inadmissibility," I-601, during or after his interview. In the past, a history of drug convictions, and even admitted recreational drug use, had resulted in lifetime bars from immigrating to the U.S. That policy has since become less likely to be enforced.

Simply providing evidence at the Embassy would not normally satisfy the requirement of overcoming a "character" visa denial; the formal waver application, $585 fee, must now be submitted Stateside (formerly at the Embassy, but that has changed) for review and processing.
