  • IR-5 parents visa

    My sister is a US citizen .She applied for my mother 6 months ago. Few days ago my mother's application approved. I want to know how much time it will take to face the embassy and what is the process?

    I would highly appreciate it if someone share experience with me.

    There are three steps through which a parent petition (and any immigrant petiton) must go:

    1. USCIS petition approved, now completed for mother.
    2. National Visa Center, for payment of two fees, submittal of sponsorshi and civil documents and completion of online DS-260, about 3 months.
    3. Embassy interview, about 5-6 weeks after NVC is finished and sends appointment package.

      I have another question ...

      My sister applied for in the F4 category approximately 2 years ago. I age is now 19 years. In the application she mentioned my age.

      I want to know that :-
      1.In which category my application will be processed?

      2. Can my sister adjust my application status and what is the process?

        Your visa class will remain F4, regardless of your age.

        You cannot be adjusted until your visa quota slot become available, 12-23 years from when submitted, depending on your country.

        Once your mother gets here, she should immediately petition you and that should qualify you faster, unless you "age out" first.

          I have two question on my mind..

          1.I heard that there is a chance to go with my mom . Is that true and is there any process?

          2. Can my sister adjust my status F4 to F2A now so that I can go with my mom?

            Mom has to petition you after she gets to the U.S., and your class from petition would be F2A of F2B (depending on your age).

            Your sister cannot change the class of her petition to you from F4 to F2A.

            Your mom's visa class, IR-5, does not allow for dereivative visas of her children. If anyone has told you otherwise, they are misinformed.

              I know that in the IR-5 parents visa there is no derivatives children facility ....

              Someone told her that she can adjust it F4 to F2A by applying ..
              Is that true?
              My moms petition already approved. There is a possibility to me to age out because I am already 19 years of age.

                Talha,

                Your sister cannot change her petition (for you) to F2A because F2A would have to be initiated by a parent in the U.S. The class of a petition can only be changed by a status change of the petitioner or the beneficiary, not a sibling petitioner.

                Whoever has told you that your sister can change your petition status to F2A is confused and/or misinformed.

                When your mom arrives in the U.S., she can immediately petition you. You might age out before a visa slot becomes available, and then your status would have to be reevaluated to see whether your sister's petition to you or your mom's petition for you becomes "current" first.

                    "Hi, I am a US citizen I have applied for immigrant visa for both my parents. the whole process started in May 2014, I have paid all the fees and submitted the civil forms Affidavit of Support and other supportive documents. Today I received 2 letters from NVC one each for my mom and dad saying that the priority date for both the cases is 27th May 2014. plz help me understand how much time should I be expecting for my parents to recieve call from the US Embassy for an interview. I would really appreciate if someone can share their experience"

                      Once the NVC sends you notice that it has finished reviewing your sponsorship and civil documents, an interview appointment package is sent by the NVC 3-6 weeks later.

                        ... How old does the us citizen have to be so theyll be able to apply there parent a IR-5 visa?

                          I have a brother and sister in the US citizens were to apply by the sister of the migration pain, but after a year providing almost has the approval of the Immigration Department and the Securities and lost that over the years the text did not go to the interview
                          Question No. Can I apply for immigration again by a brother or restore the corresponding old papers from the Immigration Department has informed that the approval of the text of the year AND HALF in 07/2014

                            My daughter, a US Citizen, filed a petition for me, her mother, which was approved.

                            Does anyone know how to now add my husband to the process. He is not legally a step father as my daughter was over 21 when we got married. I was told that my daughter could not file a separate petition for him, but is he included under the petition for me.
