  • AOS based on Marriage

I'm just wanting to see if there is anyone out there that has gotten an approval and has been in a similar situation:

My boyfriend lives in the Dominican Republic. I'm a U.S. citizen. He has a tourist visa and wants to come visit me. What happens if he wants to stay after a few months we decide to get married??

Has anyone been able to successfully do an AOS in a similar situation? Was there suspicion of whether the intent was to immigrate vs. visit?

We are so in love...and I'm afraid if he does come to visit I won't want to him to leave...but I also don't want him to get into trouble either. Please share your experiences...

    Thanks in advance...

If your boyfriend gets to the U.S. on a visitor visa and you later decided to marry and adjust his status, that will work.

If the question comes up as to if we had intent to marry when he came to visit...how do I prove that we didn't? Or would that not even be an issue by the time we got to the interview part?

Is the most important part proving we are in a bona fide marriage?

You cannot "prove" that you did not intend to marry. On the other hand, an admission that you intended to marry when he applied for his visa or entered the U.S. will result in a visa denial or a rejection at entry. If you have proof of meeting in person already, why don't you just petition him for a fiancee visa.

Well 2 reasons. We want more time together before we make that decision and also the fiance visa takes 6 plus months. That's why we want him to come visit awhile. I'm just afraid I won't want him to leave and we decide to marry...
