  • I-130 RFE - Name change

    I received an RFE for my fathers I-130 application.
    I had submitted my birth certificate which has my fathers and mothers name on it and also a copy of my parents marriage certificate.
    But marriage cert has my mothers maiden name on it.
    RFE is to prove names (mothers maiden name and after marriage name) are of the same person.
    Unfortunately I don't have any other documented proof which shows both her names together. What are my option? Can I submit just a name change affidavit?
    Any help would be highly appreciated.

    I see that you posted in February, did you submit any evidence? if so, what was it? was it enough?

    You state that you received the RFE for your dad's I-130, my question is why did they need proof that your mom is the same person (with her maiden name and with your dad's last name), when the petition is for your dad? Or did you petition for both of them together?

    Either way, I received the same RFE for proof of name change for my mother, in my mother's I-130 application. The RFE says you can send your parents' marriage certificate and/or divorce certificate. Like you, I don't have anything with my mother's BOTH names in it, I would only have her marriage and her divorce certificate, and they both have her maiden name on it, because my mother never legally changed her name.

    Please let me know what happened in your case, and what evidence were you able to send to get your case approved. Thank you,

      The obvious requirements, if you are filing for your father alone are, your birth certificate and your father's birth certificate.

      If you are filing for both parents, then you would send your BC and your Mother's birth certificate and your father's birth certificate.
      Marriage Certificates, is secondary evidence and only prove that they are married.

      So say she was your step Mom, then the Marriage Certificates would be primary evidence.
