  • Spouse of US citizen

I am a student on F-1 visa. It is valid until 2017 based on my I-20. I am applying for green card based on my marriage to US citizen. Is my F-1 status kept while my application is USCIS is pending?
Also, do I need to apply for I-765?

Your F1 status does not change until you have acquired a new status (Permanent Resident, after Green Card is issued).

If you have an EAD allowable with your F1 status (I'm not too clear about this availability), don't bother submitting the I-765 with your Adjustment package.

If not, then submit the I-765 and I-131 with your Adjustment package.

      Thanks for your response Ray.
I am not sure about that either. But, in the next two years, I am not going to do anything other than working on-campus, which is also possible with F-1. So, probably, I am not gonna need that.
I have another question about submitting bona fide marriage documentation. I see all the items in the list that this website is providing. I am wondering which are the most important ones? Also, we have opened joint bank account and credit card just 2 weeks ago after we got married. Is that OK or do we better wait a bit to have more statements and document on that?
      Thanks.

If you are being processed in the U.S. with the Adjustment of Status, I-485 and I-130 together, evidence of relationship is not that important with your submitted documents, because you will be expected to provide relationshp evidence at your actual Adjustment interview.

            Question regaridng I-485

I also have a question regarding for I485, part 3A:
"Were you inspected by a U.S. Immigration officer?"

I am not sure what to answer this? What do they mean by inspection?

Also part 3C: Do I put down any academic organization which I member of?

            Thanks

If you were processed as an entrant at a U.S. Port of Entry, you were "inspected by a U.S. Immigration officer."

Listing academic organization is your choice.

                Mailing Address

                Hi,

If we use FedEX to mail our document, which address should we use for concurrent I-120 and I-485:
                USCIS
                PO BOX 805887
                Chicago, IL 60680-4120

                OR

                USCIS
                ATTN:FBAS
                131 South Dearborn - 3rd floor
                Chicago, IL 60603-5517

For FedEx or other courier delivery, use the street address, not the P O Box address.
