  • Just got married... Happy but need help :)

    Hi everyone,

    Just found out about this forum and realy cool that everyone is trying to help each other.

    I read some Threads but everyone has a different case so i wanted to be sure about my case.

    In my situation:

    - I'm 27 years old and a turkish citizen.
    - I have a really clean and good background. (Was born in Germany, speak 3 languages, have my bachelor and masters, worked as a teacher for more then 5 years etc.)
    - Came on Dec 16th 2014 with a B1/B2 tourist Visa to the US.
    - I did a same sex marriage on Feb 18th 2015.
    - My Husband is a US Citizen.
    - We live in NYC.
    - It is not a **** **** **** * marriage.
    - My Intention is to get all documents ASAP done because I'm a teacher and i want to continue with my life, working and not being illegal for some reasons.

    My question is:

    Which forms do i need to fill? As i read the forum i think i need to fill the forms: (I-130, I-485 and I-765) Can i apply to those forms at the SAME TIME or do we need to follow an order?

    Submit the forms you list below at the same time, and include I-131, I-864, G-325A for each of you, $420 and $1,070 fee checks. Supporting documents and evidence will need to be included.

      Now i do have 3 more questions...

      1) Form I-131 is for, when i need to leave and re-enter the US. In my case i dont need to leave US. Should we anyway process this form?
      2) After we married we both took our last names... Should we use our new Last Names on those forms or the old ones how they are listed in our ID's and Passport?
      3) Should my husband change his Name on his Social Security card, driver licence, passport before those forms or after?

        Congratulation Methold!

        Attached is the link with my timeline. It shows all the paperwork I filled out and the time it took me to get my green card. It took me about 3 months.

        Good luck. If you need additional help, do not hesitate to contact me. After filling out all the paperwork, I became an expert. lol.... Do not ever pay a lawyer to fill out the paperwork for you. If you are a teacher, you will have no problem answering all the questions by yourself.

          My answer is:

          You should fill out the following forms:
          I-130, 1-485, I-765, I-864, I-693, G-325A, G-1145
          ENCLOSE ALL THE FORMS ABOVE IN AN ENVELOPE AND SEND IT TO USCIS IN ILLINOIS.

          Sending the forms in different time frames only delays the process.

            You asked 3 more questions...

            1) Form I-131 is for, when i need to leave and re-enter the US. In my case i dont need to leave US. Should we anyway process this form?
            It is up to you. I never did, because I was not planning on leaving the country any time soon. You do not have to pay an additional fee when filling the I-131 form, so it is up to you. I figured, one less form they need to analyze, one less thing they need to spend time on.

            2) After we married we both took our last names... Should we use our new Last Names on those forms or the old ones how they are listed in our ID's and Passport?
            If you have time to wait for all you ID's and passport to get the names change, go ahead. If not, Just fill the forms out with your old last name. USCIS does not require you to change your last names. During my interview, My wife explained to the officer, that we bought a tour last month with her maiden name, therefore we needed her to keep her last name for at least until the trip was over which is not until this July.

            Just wait until all the process is over and then, he can decide. I submitted all the paperwork in November 22th 2014 and I just got approved for my green card 2 days ago. February 20th 2015 (about 3 months)
