  • I-130 for parents and sister

    Hi,

    The I-130 form states that a child of a parent of a US citizen needs a separate I-130 filed for that child. I contacted the NVC in NH and they also stated this was the case.

    Why then are there multiple posts in this forum related to people filing for parents and younger siblings that say you don't need to file separately for the child (sister/brother of the US Citizen) of a petitioned parent?

    Which is correct?

    One I-130 each for mother, father and for each sibling.

      Is your sister 21 or over? If yes, you need separate petition for her.

      Is your sister under 21? No separate petition for her. She can immigrate with either of her parents.

        Hi,

        I'm really confuse now. From what i've read on CIS website, we have to file a seperate I-130 for brother/sister and of course wait for 10-12 years.

        If you had children before you became a permanent resident and you did not immigrate as an immediate relative of a U.S. citizen, your unmarried, minor children may be eligible to receive following-to-join benefits. This means that you do not have to submit a separate USCIS Form I-130 (Petition for Alien Relative) for your children, and your children will not have to wait any extra time for a visa number to become available.

          My mistake.

          Dependent children of immediate relatives of US citizens can't immigrant along with them.

          Therefore, you need to file her in F4 category, 12 years wait.

            Thanks for the clarification.

            Is there anyway that my brother can immigrate with my parent to US on some parole visas and wait for his time to get permanent residence status? Since this is only relative that I’ve left, it does not make sense to have him stay back their by himself.

              i called immigration (USCIS)

              i just called the immigration, the one that i talked to said that my minor sister could go with my parents because she will be qualified as their dependent. the consul will probably allow my sister to go with my parents under one petition I-130.
