    Hi, my husband is filling out an affidavit of support for my gc

    he is my petitioner and do not make enough as to the poverty line, so we do have a join sponsor, that makes enough


    my husband has 2 children under 21 that do not live with us and which he dose not claim on his tax returns. But he pays chil support.

    Does he has to add them to the number of people in household (so it is 4:him,me and 2 of his children)?

    If your joint sponsor lives alone, even though he pays child support, he is counted as one, unless he files them as dependant on his taxes, which I doubt.
    Therefore, it would be all that's in his household (1) and all that's in your household, which I'm gussing is two (2) Therefore, the total household that he would be responsible for is 3, three.

      I was re reading your post and I think I miss understand you.
      Ok here goes. If your joint sponsor lives alone that's one (1). You and your husband would count as two (2), therefore, the total is three.(3)

      Since he doesn't claim his two kids on his taxes and furthermore, they don't live with him, they are not counted.
      If he had filed them on his taxes, even if they didn't live with him, then they would be counted.
      but this is not the case.

        thank you so much!!!. He is a joined sponsor (not a house hold member) but he still has to put that there are 3 people in his household, correct? (about joined sponsors i864)




        and question about my husband ( his i864) - how many people he supposed to put in his house hold,2 (me and him) his children to not live with us and he do not claim them on his tax returns?????
