    Hi, I am filing green card application for my mom now, but our household income is below the poverty line since we just had a baby at the end of last year and here we are having my mom add to our family.
    My mom is from China and she has been retired for couples of years. She has steady retirement income comes in every month. My question is, can I use her retirement income from China as a part of our household income when I file I864?

    If your mom is now in the U.S., the following citation from the instructions for the I-864A, Household Member contract, may apply for your mom's continuing pension income:

    "...The intending immigrant has the same principal residence as the sponsor and the intending immigrant can establish that his or her income will continue from the same source, even after acquisition of permanent resident..."
