Hello everyone,
I have found this website to be the most updated cases so I am hoping to get as much advice as possible for our application. I am a Bangladeshi national and I entered USA in 2009 on F-1 visa and finished my bachelors studies in 2013. I met my husband in 2012, started officially dating in April 2012 (We are a same-sex couple). We got married on May 6, 2013 (and had an epic road trip together to NY to get married, Indiana did not have gay marriage allowed back then). I have been on OPT and now on OPT STEM extension with a full time job (Expiring on November 2015). We are about to submit our application and hope to move to NYC together after my employment goes through. Here is a list of documents I am submitting (please comment if it looks good, we are very serious about this, we are very dependent on each other emotionally lol):
I-485
G-1145
Check for $1070
I-765
Maybe I-140 (I'm not sure if I will, I don't plan to leave the country)
My birth certificate
Copy of my passport pages
Copy of visa
Copy of I-94
2 photos of myself
I-693 medical report
My G-325A
I-864 (the one issue I have explained below)
I-130
His birth certificate (he was born in USA)
Marriage certificate copy
1 photo for each of us
His G-325A
G-1145
Check of $420
Evidences:
Joint bank account statement and debit cards
Joint phone contract
Joint health and car insurance
Leases (we have two for each of us both guarantor for each other)
Listed emergency contacts for each other
Joint tax return for most recent tax year
Notarized letters from his parents, our friend through whom we met and another mutual friend talking about our marriage
Photos of marriage, hangouts etc (we have TONS, not sure how many we should submit)
Possibly phone records (advice?)
As far we are concerned, there shouldn't be any red flag for our relationship since our lives are literally entangled but there's one part of I-864 that we're not sure about. No.13 where it's a checkbox for three year tax return: He was a student till May 2014 and I was the one working since 2013. He is a pharmacist and we make way over the 125% poverty line together, but he never had a job before so never filed taxes before this year (that we did jointly), I feel like it would be untrue to check that box but there's no other option to explain it. What should we do about it? I filed taxes the year before but he never needed to, so is that going to be an issue? Can we explain it in a separate sheet?
That's the only issue we have before filing, please let me know if you had/know of similar situation. Our case feels very solid except that I am from a muslim country and my parents are not aware of this, which shouldn't be weird to explain for a same-sex couple, but his family is basically my family too. So please help me on what to fill out for that checkbox. Appreciate all the help we can get! Thanks!
