    My Father had applied for immigration for me, my wife and 2 children. The date for initialization for immigration process came last year in may 2014 but by then my father(the petitioner) has moved to india and was sick.Thus, we could not initiate the process. He expired in january this year.
    Now,again the embassy has sent a letter asking if we are interested to move to US or if not interested, then let us know the same.

    I have following queries:
    1. Is there any requirement of the petitioner(my expired father) from this stage on?
    2. If yes, since the petitioner has expired then can somebody else, another relative based in US, can help with the process or not?

    Amarinder,
    You must be under Family F3 Category. Please search the "ALL F3s" Thread in this Forum. There was a similar case. When the Petitioner dies, the immigration visa petition is automatically revoked. But you can get is reinstated on humanitarian grounds. This guy hired a lawyer and he got his petition re-instated.
    So you need to do the followings:
    1. Response to the letter that you are interested in going to US.
    2. Get a lawyer, so that your petition is re-instated (it takes quite a time, read through the thread I mentioned).
    3. Your other relative's can submit the substitute affidavit of support.

    There is no requirement from the petitioner (as he has expired).
