  • Marriage question

I married my husband 2 months ago. He's applying for citizenship and said he needs my taxes. His uncle is going to be his sponsor, so does he still need mine. Last year I lived with a friend and this tax season she told me I could put her kid in my taxes and get some of the money, I did that. What's going to come of this?

I am assuming, you're petitioner and your husband is beneficiary. First of all - you need to apply for his Green Card (Permanent Residency) unless he has Green card from previous marriage (since you recently married). He can't become Citizen unless he already has Green Card (permanent residency).

    1. Even though his uncle is going to sponsor, since you're petitioner - you'll be primary sponsor and his uncle will be co-sponsor / joint-sponsor. USCIS will need your tax return along with his uncle tax return.
    2. Sorry to say - this is big fraud to IRS. You need to consultation with lawyers if you planning to file petition now or in-future.
    i. You need to wait 3-5 years before your husband files for GC/ Citizenship. USCIS ask for atleast last 3 years tax return information.
ii. You need to sort this issue with IRS, before you file petition which can result in huge fine. Although there are many cases where dependents are claimed improperly.
