I-864 Income question

  • I-864 Income question

    Hello,
    I got Married to a US citizen, and I am on a F-1 visa at the moment. The only document I am missing is the I-864 because I am not sure what to put for my sponsors income (my wife's parents).
    They own a business together, and therefore the money that shows in their w2's is not that much, since most of their "income" is shown in the 1040 Tax return for the business (line 22) . Since they both own the business equally together, I am not sure how to split the income + their individual w2's incomes.

    Also I am not sure if I should fill two I-864 forms, or One I-864 and one I-864a form.

    Please if anyone knows I would very much appreciate it. This is the only thing left to send my papers in.

    Your U.S. citizen spouse must complete the I-864 as the primary sponsor. The parents can them complete an I-864A as household member joint sponsors if living at the same address or a separate I-864 and I-864A as separate joint sponsors.

      I understand that, but I am not sure what amount I should put in my wife's parents forms, under annual income. Would It be : Their w2's income + half of the 1040 tax return , for each one of them ? (Since the 1040 is under both of their names together). Or how should I determine the income number to put in the form (The thing that is confusing me is the fact that they share the business and I don't know how to handle that number) .

        You must first decide if parents' income will be joined with your husband's income as household member joint sponsors, to be included on his I-864.

        There will then be two income amounts for each parent: estimated annual income and tax return income. If they are equal business partners, and receive no other income than what is generated by the business, split the total income (line 22, form 1040) in half and show that half for each's annual income amount. But the income tax income for each should be the same, the line 22 total income from the tax return.

          And should I add line 16 from the w2 (states wages, tips, etc) as well onto their "half" from the business? Although the income from line 22 of 1040 is already enough.

            If they share a business together and file a Schedule C business return, they wouldn't normally have W2 income, unless they also have wage employment or their business is a corporation which issues each W2 forms.

            In answer to your question, however, each's estimated annual income should be a realistic amount supported by current documentation of ongoing income.
