I am currently in the process of concurrent filing for I-130 and I-485. This is because my wife just became citizen and we have been married more than 4 years.
I understand that I864 can be waived if one can show proof of 40 qualifying credits. I checked the social security website and my statement has information for my work since 2006. However, I have paid social security and medicare when I was student and when I was on OPT in 2004 and 2005. Assuming that I would use what is shown in the social security website, I need 4 more quarters to meet the qualifying credits. I864 allows you to get credits from your spouse.
Can I submit a copy of her social security statement and compensate for the 4 quarters that I do not have.
Please advise.
