I am currently an H1B visa holder in the US (from England), and I'm getting married to a citizen in three weeks time and applying for a Green Card. My question is a rather complicated one regarding travel.
I understand that I can apply to travel while my green card is pending with an I-131. However, my current visa stamp in my passport is an F1 visa; I had a transfer of status to H1B while still in the US and I have an I-797A form confirming this, but I understand that were I to leave the country I would need to go to the embassy in London to get a proper H1B visa stamp. My question is whether I still have to do this if I get an I-131 re-entry permit. My fiance and I are planning to visit my family in England over Christmas, but due to work commitments we can't stay long enough for me to have time to go to the embassy and get a visa stamp back in time.
Does anyone have any ideas for me?
