  • Will my sister be able to come along with my parents, if I file their petition

    Hi There,
I’m hoping someone can help me to clear up my confutation.

I just become US Citizen and I would like to petition for my parents and unmarried sister (25 yrs old).

My sister is 25 years old and currently unmarried, Will my sister be able to come along with my parents, if I file their petition (parents and sister) at same time.

If not, then what’s the waiting period for sibling?

Thank you very much in advance for your assistance.

    Thanks,
    Ravi

    No.

Current wait time is around 13 years.

      Hi Ravi!

Congratulations on your naturalization. I myself took the oath ceremony only last Wednesday.

You can file relative petitions for all your family members. But, visas will become available to them at different times.

Please read the latest visa bulletin for more information http://travel.state.gov/contenthttps...june-2015.html

Both your mother and your father are considered immediate relatives of a United States citizen, and will receive an immigrant visa immediately.

Your sister is considered category F4, fourth preference, with respect to you. Like immihelp says, it will take about 13 years until her immigrant visa becomes available.

If your parents accept their immigrant visas, they will enter the United States as lawful permanent residents, and soon thereafter receive their greencards in the mail.

As United States Lawful Permanent Residents, they themselves have the right to file relative petitions for their family members. In this case, they can file a I-130 petition for their unmarried child - that is, your sister. Your sister would be considered category F2B with respect to your parents. The wait time in this category is 7 years. If she gets married before she receives her immigrant visa, she will not get the immigrant visa.

It is possible for both you and your mother (or father) to file petitions for your sister. The petition filed by you would serve as "insurance" in case your sister gets married in the next 7 years. If you think about it, paying $420 for this insurance is prudent, given that your sister is in her prime marriage age.

        Thanks for reply.
My sister is getting marriage next year so I don’t think she will get immigrant visa.
What is best way to approach this situation?
As a Citizen, I should file petition for my married sister or as a permanent residents, my parents file petition for my married sister.

If the filing fee is not an issue, the best course of action would be for both you and a parent to file petitions for your sister. The first thing you need to do is file petitions yourself for the three of them.

OK. I’ll file petition for three of them now. What procedure do I need to follow next year when my sister get married and her marital status change.

Nothing. Siblings under a sibling petitions can get married. When her 13 years is up, she can get green cards along with her husband and children at that time.
