  • Green card for unmarried son over 21

Hello, can a green card holder request a green card for her over 21 unmarried son?
Any idea how long this take? Months? Years? Can he request it once he is already in the US?

Situation: his sister is a citizen. His mother is a green card holder.

    Thank you

Yes, his mother, who is a Permanent Resident, (Green Card), can petition for her 21 years old unmarried, son. It will take approximately, 7 to 8 years.

If his sister, who is a US Citizen, petition for her 21 years old brother, it may take approximately 11 to 12 years.

The waiting time depends on which country's quota wait he will fall under. 7 - 20 years for F2B class. Mexico is the longest wait; Philippines is next; and remaining countries just over 7 years

He must not marry while waiting or he becomes subject to cancellation of his petition or a longer wait if the petitioner becomes naturalized.

BTW, the age range is 21 or older, not over 21.

If he is in the USA, when his Application, becomes current, he will be able to Adjust his Status.
