  • Help for 130 and 485 for Pakistani Parents

    I am a naturalized US citizen and I am applying for my parents green cards. I am filling out I-130s for my mother and my father and trying to do it without an attorney. They are currently in the US on a visit visa from Pakistan, and I am applying for adjustment of status while they are here for the summer. I have a few questions I was hoping someone could help me with - thank you for your time.

    1. I will need to get a medical exam for them, right? Do I just have to find a doctor who will take them without insurance?
    2. Do I file the 130 and the 485 at the same time?
    3. For the question "I am applying for an adjustment to permanent resident status because" is the correct answer a? ("an immigrant petition giving me an immediately available immigrant visa number has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

        Citizen with out-of-status immediate family members... need help...

        I am in a similar situation.

        My parents and my little brother (11y) is here in the US for the last 4 years, legally, on H4. I have been accepted by the US Army on a specific program, and granted USC. Now, I am over 21 years old and would like to sponsor the rest of my family for a LPR. All members of my family have become out-of-status about 3 months ago. Can I apply for Adjustment of status for them, based on my USC?

        1. Can my parents be adjusted to LPR without Counsular Processing?
        2. Can I sponsor my little brother the same way?
        3. As I have just started my job, I do not have financial ability to support my family, being a member of the Armed Forces?

          Sir, thank you for your service. Legal Assistance Attorneys (Judge Advocates and DoD civilian attorneys) are available on nearly every base, ship, and installation. They are very competent in immigration and naturalization matters. Do not be afraid to ask them to handle these issues for you.

          1. Yes. "Concurrent filing" of I-130 and I-485 and supporting documentation for both. Any length of overstay will be forgiven.

          2. No. You file I-130 with supporting documents. Wait 14 years (category F4). Only 6 months of overstay will be forgiven.

          ALTERNATIVE: After your parents get green cards, they sponsor their child by filing I-130 with supporting documents. Wait 3 years (category F2A). Only 6 months of overstay will be forgiven.

          ALTERNATIVE: After your parents have green cards for 5 years, they apply for citizenship. They then sponsor perform "concurrent filing" of both I-130 and I-485. Any length of overstay will be forgiven.

          3. Is it possible for your parents to work and help contribute to the household? Alternatively, do they have cash savings that can be used to qualify in lieu of income?
