  • Add a child after I-130 has been approved

    Hi,

My wife is a US citizen and we live in Israel. We have one daughter 3 yeas old.
We applied for immigrant visa and we included only me in the application. the application has been already approved, we already sent the affidavite of support document (still haven`t being reviewed) and now I have to fill the DS-260.
We understand that we made a mistake that we didn`t include our daughter in the original application.

Is it possible to add her now or should we apply for another visa application?
If we can add her, what is the process?

    Thanks,
    Gal

The petitioner files a I-130 for her step-daughter.

This is not a step-daughter, she is our mutual daughter.
Should I make all of the process Separately for her or can I still add her to my petition?

Should I make it from Israel or after we will move it is better to apply it from the US?

The child of a United States citizen, under most but not all circumstances, is born a United States citizen.

The parents just need to file a Consular Record of Birth Abroad, and then afterwards apply for her United States passport.

Edit: For example, if mom had been physically present in the United States for a period of at least five years at some time in her life prior to the birth your mutual daughter, of which at least two years were after moms 14th birthday.... then your mutual daughter was automatically conferred United States citizenship upon birth. See http://www.uscis.gov/policymanual/HT...-Chapter3.html File a CRBA http://israel.usembassy.gov/consular...aservices.html
