  • whats next after approval for I-130

    Good day to all!
My husband (US citizen) filed and got the approval of form I-130 for my son in the philippines, we got the approval notice already but he wants to file the affidavit of support (I-864), does he need to wait for the letter from NVC regarding where and how to file it and the filing fee?

Does NVC take a long time before they send us the step by step instructions for filing the I-864 or can we just file it by mail with a money order, how much is it gonna cost and where to send the papers?

How old is your son now? That will drive the next sequence of steps.

You cannot submit the I-864 to the National Visa Center until your son's priority date is reached (if the petitioner is not a U.S. citizen, of if the son is age 21 or older).

Once you have the $120 fee bill from the National Visa Center, and pay it, you can then submit the sponsorship (I-864) documents.

But it is better to wait until you have paid the $325 visa bill, then submit both sponsorship and civil document copies at one time.

Actually, if you received the "Welcome" letter package with the single cover letter included, you can submit both sponsorship and civil documents before you pay the $325 visa fee.

*** My son is 13 years old turning 14 this end of Dec, 2015. The petitioner is a US citizen, my husband. We havent receive any welcome letter package from NVC yet, we just got the approval notice for Form I-130 last week. Will NVC send us instructions step by step? I dont know what you meant by visa bill, i thought we are only paying the I-864 fee and my relative will pay the visa bill back in the philippines once i-864 is already approved. Please elaborate. Thank you!!!!!

I'm sorry, but you've had expectations about the remaining process that are simply not accurate.

In another 30+ days you should receive a "welcome" packet from the National Visa Center, which will include a bill for $120 for sponsorship processing. You will then need to go onto the NVC page for the case, using the State Department case number and the invoice ID number, to pay the $120 fee online and to complete form DS-261 to name a Stateside person to be the agent to receive all NVC correspondence. You will later get a visa bill for $325 to also pay online, followed by filling out form DS-260 online.

NVC does not provide instructions for each of these steps. You must simply respond to each step as it becomes available to you to complete.

I apologize for the confusion but this is the first time I am going to process papers for a relative thats outside the US. Is this DS-260 an Adjustment of status because we only plan to adjust his status once he steps in the United states. We thought that I-130 and I-864 will be enough to get him here then we can adjust his status after that. Does this DS-260 take a long time to get approved?

            Marie,

There is no "Adjustment of Status" when processing an immigrant while outside the U.S.

After the I-130 is approved and goes to the National Visa Center, you will have to do the following

            1. Complete form DS-261 to name an agent
            2. Pay online fees of $120 and $325
            3. Submit I-864 sponsorship package and copies of civil documents
            4. Complete form DS-260, visa application

The entire National Visa Center process, as described above, will take about 3 months.

              Sir Ray B,
Is this DS-260 a green card for him when he gets here? Or do i need to file an adjustment once the DS-260 gets approved?

Thank you so much for the help! I appreciate it. Im sorry for my ignorance.

As I just wrote in my last message, there is no "Adjustment of Status" for an immigrant whose paperwork is processed while he is outside the U.S.

The DS-260 is the online visa application which must be completed before the National Visa Center completes its processing, and the applicant must take a copy of the DS-260 and its "Completion" page to his Embassy interview.
