    So my boyfriend is here on an L1 Visa that ends at the end of this year. We are very much in love and would like to get married. I am currently in the process of a divorce. Is it better to get married before his visa ends? Will it be harder for him if he comes back on K1 fiance visa, and we get married, for him to get his greencard.

    You can marry him before he leaves if you are past 6 months your divorce,different states have different time periods after divorce before which you can't remarry. The reason is for all the divorce paperwork to be recorded. The only flip side of applying once he is in India is that you guys will have to go for consular processing the avg processing time for which is more than the processing at the local UCIS and DHS offices in US for Indian citizens.

    You can call the local county court where you want to marry him and find out about how long you need to wait before remarrying.

      Sorry if I was not clear in my previous reply. If he goes back to India you have to go to India too and then get married. Once you are married you need to file for his family based green card and it would be consular processing meaning it will be processed in the USCIS India office. Usually the average time for consular processing it quite more than filing when he is already in US. Besides you are saving on the trip to visit India come back etc. If you hire an attorney which would be my advice to make sure the paper work is solid there will be attorney fees and also you have to pay the requisite govt fees for immigration which is $2500. If you add up all the costs its quite a bit expensive.

      I would want to keep things easy, get a divorce marry him in a US court so that the verification of the marriage is quite easy, sign up a lease for apartment, utilities, open up bank account and credit cars, sign up or add him to health insurance and after 3 months file his i-130 and I-485. So that way he will have sufficient time to get his EAD, AP etc approved long before his visa even expires.

        What shockes me the most in relationships is how fast people give up. Good for you that you look to ways to keep the relation going. I have friends who have quit chatting with girls because of the distance and the documentation problems between countries. The most problematic is the US with their Green Card and the other paper that you need for living there. It's easier to date girls from the States, as getting out from there is easier than getting in, but also men who are willing to leave their home and move to yours. But you can't ask a person if she's willing to do that on the first date. I think I got too deep into this.
