I need some urgent advise. My husband has a warrant for his arrest since 1993 in the US. He has been traveling back to the Caribbean (home ) since then and nothing occurred. In 2009 his visitors visa needed to be renewed. He went back home to Caribbean to do this, and was told who was denied due to the o/s warrant . I petition for him and his interview is in a few days. Since 2009 he has not travelled was told by the consults at the US embassy he deny him that he should let his wife petition for him.. We have a criminal lawyer awaiting his arrival to the US to represent him. Anyone knows of a similar case. He has no other major charges. He did not go to court in the US and he did not plead guilty of the offense which was Criminal Substance in the 7th degree. Our lawyer thinks he can expunge the charge since it so old. My question is, will they allow him back in the US? He has no other criminal charges in the US or home in the Caribbean. We have two young children who are US citizen. I am a law abiding US citizen. He worked with UNICEF in the Caribbean teaching inner city youths music.

There was someone here in this forum a few months ago, the citizen spouse of a Jamaican national charged with possession of cocaine in New Jersey. I have not seen her back here to post an update, but I guess your situation is not unheard of.
They will want a certified copy of his arrest records at the consular interview to determine if he is admissible to the United States.
If they find him inadmissible, they will let him file a waiver request. The waiver petition will require him to clearly convince them that his exclusion from the United States will cause extreme and unusual hardship to his citizen spouse and kids.

That was my post...he is finally at the interview stage. And yes my case is very unique, since he didn't plead guilty, he missed his court date in 1993. Praying for a favorable outcome we have two small children and I need his help. Don't know if the waiver is granted in this case, since he don't have a conviction.
