  • Conditional Green card holder gets Naturalization

    One of my friends got her green card through marriage. Her husband was an American citizen, so she got a conditional GC on November 2002. However, the marriage didn't work out right. After living about a year together they got divorced. She applied to remove the condition a few months befor two years and the condition was removed on Nov. 2005. Now she is on regular GC.

    According to INA 319 (or INA 316) she could get Naturalization after three years if she was still in marital status. However, the INA acts are not clear to me about her situation. She was in the "battered" condition and lived with her husband for more than a year.

    Do you know when she will be eligible for naturalization? Is it 5 years since Nov. 2002? or She can get any advantage of 3 years?
