  • I 130 Approved Please help with questions

    Form I 130 has been approved for my brother in law. He now lives in Australia. He was a citizen of Mauritius before. His visa center has been allocated to Johannesburg. I have just paid the AOS fee it is still pending [paid just yesterday]. We are trying to collect the documents and waiting for the form DS 260 to open up. Please help with the following questions:

    1) I have emailed NVC to change the processing center to Sydney Australia a week ago. Do I wait until they change this center before sending any documents or just keep proceeding with sending documents?
    2) My wife applied for her brother. Now he is married. The website shows only my Bro-In Laws name. How do we add his wife to the application? Will we get an option to add her to the application? If so at what stage?
    3) Since they migrated from Mauritius at age 22. Do we have to get Police Certificates from both Mauritius [from age 16 to 22] and from Australia [from age 22 to 27]?
    Or just Australia is fine since that is where he is living now?
    4) How long does it take for the Form DS 260 to open up? We are not able to find this form DS 260 to fill. Can this form be filled by me [the agent] or only the petitioner has to fill it?

      2) Apparently I have to email asknvc with the wife's name, info and attach a birth certificate and marriage certifiate for this to happen.
      3) Yes, you need police certificate from both places.
      4) Do not know, computer glitches gallore..

        I think you're missing something here, as the protocol for changing processing country is fairly standard, and I've succeeded in doing it twice (India to Pakistan, and Bahrain or Kuwait to Manila).

        The response I received first was to provide proof that beneficiary had legal status in the destination country, citizenship, residency or employment visa, and to mail these with a formal request to the NVC.

        I think a response of this can be obtained from the the NVC messaging application:
        http://travel.state.gov/contenthttps...t/ask-nvc.html and reason for query would be "change processing post"

          Hi!! Do you actually receive any letter from NVC? because in my case i-130 is approved in 15 january but we didnt get any letter from NVC, only a letter from USCIS that says you application is approved and is tranfert to NVC. Is it normal so much delay for a welcome letter from NVC?

            Yes, we got the letter from NVC saying this is your center for visa processing, these are the steps you need to take etc..

              can you tell me how long take to approval i 130 if spouse is green card holder and both are staying in usa.
