I am sponsoring my husband to get his green card in February 2016. I am a US citizen and have filed tax returns for the last three most recent years. The problem is, for the previous two years I was moving in and out of different states so I could not meet 125%of federal poverty guidelines for those previous two years (for a household of two), but this year (2015) I will have enough to meet the 125% poverty guideline because I have been settling in one place.
I realized that on form I 864, part 6-13 gives the option of choosing only to provide the most recent year (in my case is 2015) tax return, instead of having all three years of tax returns. So I am wondering if I only submit the most recent year's tax return, will the USCIS give me troubles? or, should I submit all three tax returns and include a letter explaining why I don't have enough income to cover up the 125% of the guideline for the previous two years? if so, will being unstable in those two years work against the whole case or work for the whole case?
