  • Family Sponsorship Green Card Application Questions

    First of all, I'm completely lost on the whole green card process. I've looked up and down the websites, and they never seem to be clear enough for me to understand. My fiance and I are getting married next week in Canada (I'm the American. He's Canadian). We plan on returning here and starting our process for his green card. Because of this, we're hoping he can stay in the States while this whole process is going on and just come as a visitor until he receives his work permit (fingers crossed). I would like to know if it's faster for him to apply from inside the U.S. or outside. If we did outside, it would be through consular processing. He can stay in the U.S. while this is processing until he has to go to his interview. I'm thinking it's easier if he applied inside the U.S. though and sent in Form I-485 and Form I-130 at the same time. Now if we do that, I know he needs to have a medical exam, and Forms I-864, G-325A, and I-765. Do I also need I-131 since hopefully, he'll already be here? I feel like I'm missing some crucial piece of information so any help would be greatly appreciated!

    Hi,

    The medical exam form is I-693, you have listed all the correct forms> You just need to collect all the supporting evidence. Send in as much info as you can. Please do not admit that he is visiting to marry, there is a procedure for this. he should apply for a fiancé visa. I think that's K-1 (not very certain). If they think that was your plan, there will be consequences. Also if you get married before he has been here 3 months, there is a red flag. Visit www.uscis.gov and read up on all the forms and instructions that come with them. It is mostly common sense, and the blogs do help.

    • Evidence of joint State Farm credit card account.
    • Utility bill in the names of Fernando and Keisha.
    • Phone call and messages records for Fernando for past six (6) months, evidencing correspondence between himself and Keisha.
    • Copy receipts for engagement and wedding rings bought by Fernando from Kay Jewelers, Mongolia Mall, Mongolia, Pittsburgh, PA.
    • Copy receipt of doctor and dentist bills for Keisha paid by Fernando.
    • Copies of Citizen’s Bank ATM generated check lodgement receipts, evidencing monetary gifts from Fernando to Keisha.
    • Copy receipts for gifts and various items purchased for Keisha by Ronald.
    • Copy receipts for gifts purchased for Fernando by Keisha.
    • Copy receipts from dates between Fernando and Keisha
    • Photocopies of debit/credit cards used in purchases, from both parties, for reference.
    • Photographs of wedding day etc. with brief notes on backs of each.
    • Copy bank letter and statements, evidencing change of address for Keisha.
    • Evidence of correspondence by mail to Keisha at 171 Antonio Way.
    • Copies of postcards and envelop sent to Fernando and Keisha, from Keisha’s family in Jamaica, and Fernando’s daughter, Meika.

    • Completed Form I-864.


    SUPPORTING DOCUMENTS (COPIES) TO FORM I-864:


    • Job letter for Fernando, stating job classification, tenure and expected salary for current year (2015).
    • Pay stubs for Fernando, for past 6 months.
    • Copies of tax returns for 2012, 2013 and 2014 (original IRS transcripts).
    • Statement from ICMA account: January – June 2015, and print out of account as at July 30, 2015, which is used as supplemental income in part 7.



    FOLDER 5:


    • Completed Form I-485.
    • Completed Form G-325a.
    • Signed passport-style photo (x4) of Keisha.




    FOLDER 6:

    SUPPORTING DOCUMENTATION (COPIES) TO FORM I-485:

    • Birth certificate for Keisha.
    • Passport biographic data page for Keisha.
    • Passport visa page for Keisha and passport page with CBP stamp of last entry into the US by Keisha.
    • I-94.






    FOLDER 7:



    • Sealed envelope containing form I-693, completed by Dr. Paul Frith, P. Frith, MD and Associates, 4520 Somber Avenue, Pittsburgh, PA 15274, USA. The required medical was done on July 27, 2015.

    Seeing as you two will be married in Canada, I think consular process might be the route you'll have to take. You could always consult with a lawyer, free of charge.
