    Hi,

    I just got US Citizen in last month. Now I have to petition for my parents and my younger brother who lives in India. I know that I have to do separate petition for my mom & dad. My brother is only 18 years old. Now my questions are;
    i) Can he comes with my parents or not?
    ii)Can I put him as a dependent on my parents?
    iii) Or I have to do separate petition for him too?

    Please reply....

    My understanding is that you cannot put him down on your parents' application because this immigrant category doesn't allow derivative status. Your parents are the beneficiaries of the family based immigration through you. When they receive their permanent status, they have to apply for him. Have you already filed for your parents? You want to do it asap. It takes about 1.5 years until visa interview. You said your brother is 18 years old. One of your parents have to apply for him immediately after they receive their permanent resident status. For unmarried children under 21, the process can take up to 2 years. You want to make sure he will not age out, as the processing time changes to up to 7 years over 21 (as it is a different immigration category).

      Do i Need to attach my parents and my bothers original documents like my original birth certificate, my bother's original birth certificate and my parents original marriage certificate?

        Parents and brother

        Do not confuse between parents application with brothers application. You will NOT be applying for your brother if you want a quick approval. File for your parents without your brother. You will need your birth certificate, your father's and mother's birth certificates and their marriage certificate, and of course your naturalization certificate or passport. That is all.

            Never send original documents. You could send them to your parents, they may need to take those to their interview. Good luck!!!

              Hi, You have to file two separate I-130 petitions. One for your parents and one for your brother.

              Being parents of a UCS, your parents don't have to wait for a visa to become available. So if every thing goes OK they they will be joining you in 12 to 18 months time.

              But it will take your brother about 12 to 14 years to come to USA. So you MUST file for your brother NOW.

              Send COPYof your birth certificate and your parents marriage certificate (ALONG with NOTARIZED ENGLISH TRANSLATION, If certificates are NOT in English language).

              Keep the ORIGINAL papers with you until NVC ask for it.
