My cousin Entered on B1/B2 in 2010, later he Applied for F1 in march 2011, it was denied, then he filed I-290b, and F1 was Approved, by the time F1 was approved He got Married to USC, in June 2012 he Filed I-485 based on Marriage, it was Denied a year later, This happened in Dallas TX, when case was under process they moved Louisiana ( His Wife is from Louisiana ) He filed 485 again in 2014, it was under process and they separated ( left each other ) before the interview cause of his wife doing drugs, Attorney advised to file 485 based on I-360 (battered spouse), They Divorced in May 2015, Now He is with someone from India and they are getting married soon, she is on H1 Visa, can she apply for 130 based on his pending I-485 or He apply for H4 ? he got EAD recently,
