Hi everyone,
I'm in the process of petitioning for my spouse who fell out of status about 3 years ago. He came here as a student, never been in trouble with the law and has never been in deportation proceedings. My problem is I don't work so therefore I have no income; his uncle works and he is willing to fill out an affidavit of support on his behalf. Do I as the sponsor(American citizen) also have to fill out an i864 or does he(the beneficiary, which is my husband) have to fill one too?

He doesn't have to fill any but you have to fill one despite you don't have any income because you're the primary sponsor and his uncle will fill one as the co-sponsor. In addition, you will have to add a letter stating why you haven't filed taxes.
