    I and my sister are over 21 years of age but we are eligible under CSPA(should be). On the CEAC website, the invoice for AOS and IV Application Processing Fees shows only the names of my father(Principal Applicant), mother and youngest sister and not ours. Why is this so and what do I do? Should I be worried?

        Have you received AOS invoice for your brother and his wife? If so, collect all the supporting documents and fill out DS-260 (include your nephew's names on DS-260). and write this SAMPLE letter to the NVC when sending the documents. NVC will send another invoice for both of your nephew once the visa date/priority date confirmed that they are qualified for CSPA. (recent experience with CSPA). I am currently waiting for NVC to review all the documents.

        Dear NVC case analyst,

        This letter is to inform that I am sponsoring main beneficiary and derivative beneficiaries of case number BMB YYYY YYYY XX.

        The case number BMB YYYY YYYY XX consist four individual named ABC Patel (main beneficiary), followed by derivative beneficiary DEF Patel, GHI Patel and JKL Patel. I would like to inform you that under the case number BMB YYYY YYYY XX, one family member name JKL Patel, son of ABC Patel has not received NVC payment invoice because his situation might be considered under Child Status Protection Act. Kindly, please review JKL Patel’s information and let us know if you would need any more information for him.

          We're waiting for the priority date to become current before we move the process any forward. Also, the lawyer took all of our info when she was filing my father, mother and youngest sister's DS-260s.

            You both are eligible under CSPA, Please send NVC a letter, sample posted by dPatel below. Or if your case is already at the embassy and interview is scheduled, inquiry with the Consular officer at the interview time. The CO should be able to guide you what to do next. Ask your lawyer to send this letter to NVC.

              if both are eligible under CSPA - please submit DS 230 - manual form with fees and send to NVC for further process when the priority date is current. ( this is not legal advise)
