  • Husband has passed away during the final stage of Green Card processing

    Hi,

One of my relative's Husband has passed away recently. Wife Green card is currently under processing.. Currently She is awaiting for her Visa Interview and Medical tests in India.

    Now I have two questions:
    1. is there any impact to her Green card processing.
    2. How soon she needs to inform the immigration department about his husband's death.

    Please suggest

    Thank you

Sad to hear that. As far as I know, the application won't be revoked if the case was approved before the petitioner's death. The maximum time period to inform the immigration department is two years but in this case I believe it's better to let them know ASAP as she's waiting for interview and medical. They (immigration department) will be able to suggest her the best way to go for it.

      1. Was her husband a GC holder or US citizen? Very important.
      2. How long have they been married.
      3. Did her husband submitted all the papers for her.

If the husband is the main beneficiary and wife is a derivative beneficiary on the green card processing then this will affect wife's immigrations. Per US and NVC law, the derivative can only enter the US if the main beneficiary is alive.

I am sorry for your loss, but if the husband is the MAIN beneficiary and is no longer living, the file gets revoked.
