  • Advice Needed: Important - Immigration and B-2 Visa.

    My mother has a 10-year multiple-entry B-2 Visa. She was sponsored by her sister, who is a US Citizen. She came to US for a month in 2013 and returned back promptly.
    My mother is now in US on her 2nd trip. My Aunt (Mother's Sister) is now willing to file for her immigration.

    I wanted to understand the implications on her B-2 Visa if her Green Card is filed. Because of a family condition, she may have to visit the US every year going forward. Will she run into problems when re-entering US or if she applies for a B-2 Visa extension when in the US (if she has to stay for more than 6 months)?

    If she is given visitor visa before the immigration petition is filed, there is truly no implications to it. Just make sure that you be honest on I-130 and where there is a question "if the person intended to immigrate to the US has every been to US."

    She can continue to visit the US while her immigration petition is being reviewed.

      Thanks a ton for your reply. Another Question - After my aunt files the immigration petition, can my mother stay in the US beyond 6 months (if the B-2 Visa is not extended)? Or will she have to return to India after 6 months (as mandated by the non-extended B-2 Visa)?

        No, she shouldn't stay here after the six month term, if she stays here for longer than 6 months it can cause problems processing future immigration petition.
