I am on F1 visa right now, I am enrolled in the Fall quarter and the classes end on mid DEC 2015.
I am getting married in mid OCT 2015 and applying for the Concurrent Filing (I-130 + I-485 + everything else) just after we get married. I am already gathering and filling all documents to be ready to send on October.
Today I let my school counselor know that I will be getting married soon, then I wont be studying after DEC anymore.
She told me that it doesnt matter if I get married and apply for the green card, that I need to study to be on status until I get the green card approved, and then after that I could stop studying (and fill a form so they can cancel my f1 visa)... or else, if I quit school in DEC I will be out of status while I am waiting for the green card answer. WHAT???
As long as I know, as soon as I fill the I-485 and get the notice that USCIS received my documents, I am already an applicant waiting for the interview and I automatically not an F1 anymore.
I will be sending the AOS in OCT while I am still on F1 STATUS, 100% legal in the US, I will not be illegal at all, not even out of status when I send the paperwork. Why stopping school after DEC would make me illegal if my case is being processed already??? Is my school counselour mistaken?
Can someone confirm if I have to keep studying after is send my AOS?? Until my interview date/green card date approval??
