I am confused! Request for Initial Evidence (Affidavit of Support)

  • I am confused! Request for Initial Evidence (Affidavit of Support)

    I just got a letter requesting for more evidences for my mom's petition.

    This is where the confusion is: There are 2 requirements checklist. The first
    says "The petitioner/sponsor lists their current income on Form I-864 as an amount
    to be considered as sufficient; however, no evidence has been submitted...."
    (For this, I know I need a letter of employment, pay stubs for the previous 6 months,
    W2 for the most recent tax year. I do not have the Forms 1099 and 2555.)

    The second checklist says "Based on the documents submitted with Form I-864, the
    income did not meet 125% of the poverty guideline....."

    For 3 household, poverty guideline says I should make $25,112 and make about roughly
    $50,000. I also know that I did not submit any pay stubs or W2. I only submitted
    federal tax return transcripts for 2012, 2013, and 2014.

    My hunch is I am option number 1. I am just not quite sure because why would the
    letter give me 2 very opposite checklists?

    I hope I am correct in my guess. Please confirm!

    Yes, send all supporting, work evidence you listed and certified Tax Returns for the years along with your W2.

      The letter only asked for W2 for the most recent tax year. So that's all I am required to submit, right?

            Affidavit of Support- Questions

            Hello guys,

            NVC sent me a letter and said that I need to fill out the form again (I have submitted all the necessary paperwork- Income and other related paperwork about my parents); however, I do not need to send the I-864 and my proof of income to them but have to send to my country for my parents so they can bring it to the interview. I've sent all the paperwork to my parents about 2 weeks ago. I petitioned them around July last year. Any idea when will they send the interview letter to my parents? they said "do not send them any documents" so should I still send the W2s to them because I didn't send it previously or I just gave it to my parents as they requested.


            "Dear Sir/Madam:

            The National Visa Center (NVC) received your inquiry regarding the immigrant visa petition
            The NVC received all documentation necessary to complete processing of your case. Your case is now waiting for a visa interview to be scheduled at the U.S. Embassy or Consulate in HO CHI MINH CITY, VIETNAM. All parties to this case will be notified when an interview is scheduled.

            IMPORTANT: The applicant(s) should NOT confirm travel arrangements, sell property, or resign employment until the U.S. Embassy or Consulate issues a visa to them.
            We completed our review of the Affidavit of Support form and financial evidence documents. Our review indicates additional financial evidence and/or an amended Affidavit of Support form is still required. You have been sent a separate checklist letter that specifies the missing documents. You should obtain these documents and send them to the principal applicant. The principal applicant must provide the missing items to the U.S. Consular Officer at the time of the visa interview. Do not send these documents to the NVC, because this may delay your case."

              You, should send the list of requested things and amended Affidavit of Support Form to your relative. (The principal applicant), as requested.
              Do NOT send to NVC.

                  No I do not know how long from now; but I doubt it's very long from now, since NVC, has just about done with the case processing and an interview is soon to be schedule at the U.S Embassy. Good luck to your relative!!
