  • Concurrent filing sent to wrong USCIS address - will they forward it on?

Hello everyone, I hope you can help.

Application for concurrent filing of I-130, 765 and 485 was rejected and returned to me because I had dated one of the checks with the wrong year i.e. 2014 instead of 2015.

Not bad news really. So, I rewrote the two checks for $1,070 and $420 respectively (making sure they were all dated correctly), and posted the package back exactly as I had received it from USCIS (but with correct checks). Only thing is, instead of posting it to the the PO Box address that they said to post it to on the I-797C, I posted it back to the lockbox.

It was a truly stupid thing to do! Not being familiar with the US postal system, I thought that the only way to get confirmation of delivery was to have someone sign for it. So, in a panic to get the package back to them urgently (Im worried as my visitor visa expired), and get confirmation it was delivered, I sent it via express mail to the lockbox. I have now realized (having done some research after the fact), that Priority Mail can also confirm delivery even to a P.O. Box.

What will happen now? Will they send it back again or will they forward it to the correct address?

I'm a bit distracted and stressed by it, but have learned a valuable lesson - When I receive correspondence from USCIS, Don't panic! Take the time to read it through, do the necessary research and then respond! and most importantly FOLLOW INSTRUCTIONS!!

If anyone has had a similar experience and can let me know what happens now, that would be wonderful!

No I doubt it will come back to you. If there was a cover letter from USCIS and you returned the package with it on top, then it will be forwarded.

You could call also, to be sure....

Thank You for your response Mary!

I spoke to them and they said it will either come back or they might forward it on, and that I should call back in a few days (once they've received the package) to find out.

I made sure the first time I sent in my application that my current visa was in status, but now it has been expired for almost two weeks. I was wondering, as my current visa is now expired, will this be a problem and work against my application?

Any knowledge you can share, is super helpful!

You didn't say what visa you have that's now expired.

However, once you have submitted, your current applications; your application notice and approval notice, can give you some protection of stay (if that's your concern).
You will just have to be patient before you are able, at least to receive a work Authorization, before your permanent residents card can be issued.
