    Hello,

    I am a Canadian Citizen and married an US citizen who had since passed. Since his death I had applied for an I360 and got approved. The lawyer that I am using is not very good but you get what you pay for.

    I am in the process of applying for a fee waiver for the work permit and the I485. I have no income and I submitted a notarized letter explaining my situation as well document to support my claim.

    If I am not approved, could I apply for the work permit first and then apply for the I485? How can USCIS expect people who have approved I360 to pay the I485 fees when we are legally unable to work?

    Secondly if they refuse the fee waiver can I go back to my home town of Canada and reapply there. If I was to do that what would the process be since I am no longer in the USA.

    You will not be able to apply for the Work Authorization separately, to pay the smaller fee, since you won't be eligible for an EAD.

    If your fee waiver is declined and you return to Canada, you may be able to proceed with a "widow-basis" visa, but you can expect a visa fee of $325, a medical exam in Canada, and a Green Card production fee of $165. Your net fee benefit would then be about $600.
