    My wife and I are currently in the USA. I am an American born citizen, she is Colombian born. We have a 1 year old son, who was born in the United States also. Since we had our son, we have come and gone from the USA 4 or 5 times to Colombia. She has a 10 year tourist visa, and a student visa active also. She is planning on staying here with me for about 5 more months. During that timeframe I would like to try to get her green card. I am not really sure if that possible, or not. What is the first thing we should do here, as a married couple. Ideally I would like to fill it out in the USA, correct? In what order do I fill out the papers? Being that we live in a sanctuary city, does that make it faster, or slower, or change anything?

      If her visa is still valid she should just stay while you do an Adjustment of Status (Form I-485) It cost a bit more than doing a regular petition. But the time period is the same to be honest. If you have any other questions just message me.

        I am a US citizen who got married abroad and currently living with my wife in China. She also has a 10 years tourist visa (before we got married). Do you think it would be a good idea to file (FORM I-130) in China or file (Form I-485) once we settle in the US? My concern in the latter case is that it will seem to be committing a VISA fraud? Which is the best option? Thanks for your help.
