  • GC for parents (from Us or India?)

    Hello...

    1. I am a GC holder...already completed my finger printing and waiting for my interview. I am guessing that I will have my citizenship by April of this year. My question is...what is the best way to sponsor parents...from US or India? What is the quickest and most hassle-free way? I have heard from some people it is better for parents to come here on visitor visa and then to file all documents together from here. However I have also heard that this could be a little risky. So how should I go about this?
    2. Secondly, if I file all the documents together after my parents come here on a visitor visa (including a work permit), how long will it take for the work permit to get approved so that they can legally start working in the US?

    Consular processing from India is much faster than I-485 from US.

      Thanks for the prompt reply. I understand consular processing is faster, but I would like to have my parents with me sooner...i.e. by this May or June, and I am planning to file a work permit for them along with the I-485 and I-1-130. But, I am curious how much time difference there is between filing I-485 from here vs.doing the process mainly from India (i.e. I-130 here plus consular processing from India).

          GC for mother from India

          I have similar question, I thought you can not do Direct Conular Filing for parents, it is just valid for spouse. Any help is appreciated....does any one know how Mumbai/Delhi consulate act on these?

            Please read this statement on the New Delhi Embassy page;


            "If you are an American citizen interesting in filing an immigrant visa petition for an alien spouse or immediate relative in India, please write to [email protected]

            which means they do allow direct I-130 filing for parents. But I think
            the US citizen needs to be in India for 60 days before he can file direct at the embassy. Please confirm by writing an email to the above address. THe email could go like this; "I AM A US CITIZEN VISITING INDIA. I'D LIKE TO FILE AN IMMEDIATE RELATIVE IMMIGRANT PETITION FOR MY PARENTS
            AT THE US EMBASSY IN DELHI. PLEASE LET ME KNOW IF THAT IS POSSIBLE AND HOW DO I GO ABOUT THIS.''


            If they already have a visitor visa, you could bring them in US on that
            and then file an I-130 and an I-485. They could get an EAD(work authorization) in a few weeks to start work and the interview to adjust status will follow in many months. It is risky though, as they will be entering
            on a B1/B2 with an intention to stay.
