Will spouse GC be mailed to me in US or my spouse in India?

  • Will spouse GC be mailed to me in US or my spouse in India?

    Hi all,

    If the husband working in US applies for spouse's GC (who lives in India), will the GC be mailed to the husband in US or the spouse in India?

    Assuming she has been petitioned and processed, the Green Card will be mailed to her address in the U.S., AFTER SHE RECEIVES HER SPOUSAL VISA AND YOU PAY THE $165 GREEN CARD FEE.

      Can you explain what all this means? She stays in India, not the U.S. so I assume there'll be no interview or stuff? The husband has filed the paper application in U.S. and submitted it there. What does petitioned and processed exactly mean? And is this thing called "spousal visa" something different than the GC?

      And if the GC is mailed to the husband's U.S. address, how is she allowed to come to the U.S. without the GC in her hands? Is he supposed to courier it to her or something?

        Neville,

        There will be an interview at the appropriate Indian Embassy to see if she qualifies for a spousal visa. There is no Green Card issued until she arrives in the U.S.

        If the wife plans to remain in India, she should not be applying for a spousal visa.

          Thanks Ray. So if I get this correct... the husband has filed her papers in the U.S. so now she will be called for an interview in India in a few months (any idea how long on average?) and if she succeeds, they give her a "spousal visa" after which she can fly to the U.S. and then the GC will be delivered to the U.S. address. Correct? She will be living in India only but wishes to visit him atleast once a year which she's been unable to since the last 5 years after she lost her "L1 dependent" visa after the husband got a GC, and was rejected for a visitor visa to visit him.

              When u fill up DS 260 form online. You will be asked a question in a SECTION that where you want your GC to be mailed.

              So what ever address your write on that section, USCIS will mail your GC address on that.

                  Ray, thanks again. Can the wife get a visitor visa after relinquishing the GC if she's not able to keep visiting her husband once in every year (which I believe is the requirement to maintain the GC)? I'm still not clear on this.
